Terms & Conditions

TERMS: All prices are F.O.B. at our shipping point. Prices are based on current market conditions and are subject to change without notice. If you do not have established credit with us, we require a down payment of 50% with your order and the remainder will be due before pickup or delivery.  To those who have established credit with us, payment is net 30 days. All accounts over 30 days are subject to a service charge of 2% per month (24% Annually). In the event the account plus interest isn’t paid off in a reasonable amount of time (3 months) and a collection agency or lawyer is required, the purchaser agrees to pay all court and collection fees. The parties agree that any disputes arising out of the sale of these goods shall be arbitrated exclusively in the Chancery Court of Warren County, Tennessee, and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller.

SHIPPING: All sales are F.O.B. our shipping point. Please give definite shipping instructions how you would like your order shipped. If no instructions are given, we will ship to the best of our judgment without assuming responsibility. All stock will travel at the purchaser’s risk and expense. Our stock is packed with the greatest of care. If you are sending your own truck, be sure to supply a covering to protect the plants so they will not damage during the transit. We assume no responsibility after the stock leaves the nursery. Stock damaged in transit by the neglect of the carrier or any cause beyond our control is at your risk and between you and the carrier. The customer is responsible for unloading the trucks when they arrive. The driver is not responsible for unloading.

BARE ROOT: We suggest that the customer pick up in an enclosed trailer at our facilities. If this is not possible we will ship UPS or motor freight. All packing and shipping charges will be made at our cost. We have access to local delivery trucks if these are needed.

CLAIMS: Claims for any cause must be made upon receipt of stock. We will not honor any claims after goods have been accepted or made in writing within 10 days after receipt.

LIABILITY: Excellent cultural practices, many field inspections, and careful grading are given to insure the best quality and the healthiest products are grown We exercise the greatest care to keep our varieties pure and true to name and in good condition at the time of shipment, but we assume no responsibility after the stock has left our nursery. We cannot guarantee plants to grow because we have no control over the plants after they leave us.  

INSPECTION: Our Nursery is inspected by the State of Tennessee’s Department of Agriculture. A copy of our certificate will be available upon request.

DISCOUNTS: We offer two types of discounts. (1) Volume Orders and (2) payments in advance of shipment or delivery. (Discount (2) does not apply to new customers.)   These discounts will be determined when order is made or at time of payment.   If payment is not made in a reasonable time, as stated above, the discounts will be forfeited.
